I am leaving the Big Apple and am in the proccess of buying a home in Phoenix.
What are the laws the in AZ.
The info on the Segway.com is all legialize. What is the bottom line about operating a Segway and are there exceptions for using it as a mobility aid?
No more cold winters yeah!

My first real introduction to Segways was the 90 min. tour around JW Marriott Desert Ridge in Scottsdale. There I meet Brian and Darcie of Segways of Arizona. Send Brian an e-mail or look at his website and I am sure he can answer all your question.

Ummm... Bill? About your comment "no more cold winters"? Don't quite know how to tell you this... but right now, the temperature in Glendale (a suburb on west side of Phoenix) is 38. It's been below freezing most nights of the last two weeks, and daytime highs been in 50s. Did the same last year; we got no usable lemons, grapefruits or peaches this year because of a two week freeze last January.

Yes, I know it's nothing like back east (I grew up in Ohio and Pennsylvania, and the year-and-a-half I spent in Manhattan finishing college, winters were hell... those narrow streets of TriBeCa and the Financial District just served as funnels, turning those light winds into a friggin' wind tunnel.

OK, about the laws in AZ. AZ, in Title 28, specifically defines a Segway as an EPAMD (Electronic Personal Assisted Mobility Device) and, as such, are the only things "sidewalk legal" besides wheelchairs and electric wheelchairs.

If you are disabled, you can legally take them in anywhere, though some places might object and demand you take it outside, you don't have to.

Arizona Segway Legislation

Under Arizona State law the Segway PT is defined as an “Electric personal assistive mobility device” which is different then a moped, motorized skateboard or scooter. Basically the same rights and laws that apply to pedestrians apply to a Segway PT rider; however, owners and operators should be familiarly with the laws. Below is a link to the State Legislature site as well as some highlighted sections that relate.

Local communities can pass regulations regarding electric personal assistive mobility devices but have to do so specifically for them to apply to the Segway PT. Segway of Phoenix is not aware of any local communities that have restricted or regulated the Segway PT; however we recommend that you check with your local community.

The Segway PT is completely safe to use indoors. Private businesses do have the right to restrict your use of them on their property, so it is always good to ask for permission.

20. "Electric personal assistive mobility device" means a self-balancing two nontandem wheeled device with an electric propulsion system that limits the maximum speed of the device to fifteen miles per hour or less and that is designed to transport only one person.

A. A person shall not drive a vehicle on a sidewalk area except on a permanent or duly authorized temporary driveway.
B. This section does not apply to a motorized wheelchair, electric personal assistive mobility device, authorized emergency vehicle, security vehicle owned by this state or small service vehicle owned by this state or a political subdivision of this state.

A person operating a wheelchair or motorized wheelchair or an electric personal assistive mobility device has all of the rights and duties that are contained in this chapter and chapters 4 and 5 of this title and that are applicable to pedestrians except provisions that by their nature can have no application.

28-791. Pedestrians subject to traffic rules
A. Pedestrians are subject to traffic control signals at intersections as provided in section 28-645 (http://www.azleg.state.az.us/ars/28/00645.htm) unless required by local ordinance to comply strictly with the signals. At all places other than intersections, pedestrians are accorded the privileges and are subject to the restrictions stated in this article.

B. 28-793. Crossing at other than crosswalk
A. A pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles on the roadway.


B. A pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of-way to all vehicles on the roadway.
